California Vape and Tobacco Laws in 2026:
What You Can Buy and Why

Why flavored vapes disappeared, what the Unflavored Tobacco List is, what’s still allowed, and what shops can’t sell.

Key takeaways

  • You must be 21 to buy any tobacco or vape product in California.
  • Most flavored tobacco and vape products, including menthol, have been banned in stores since December 21, 2022.
  • Covered products must appear on the Attorney General’s Unflavored Tobacco List to be sold.

If you’ve wondered why a California smoke shop can’t sell the vape you saw online, the answer is state law. Here’s a plain-English summary. It’s general information, not legal advice, and local rules can be stricter.

The age is 21

California raised the minimum age to buy tobacco and vape products from 18 to 21 in 2016. Shops must check a valid photo ID, and delivery and online sellers must verify age too.

The flavor ban

Since December 21, 2022, retailers can’t sell most flavored tobacco products or tobacco flavor enhancers. That covers:

  • Flavored e-cigarettes, pods and e-liquids
  • Menthol cigarettes
  • Flavored little cigars and cigarillos
  • Flavored smokeless tobacco, blunt wraps and roll-your-own tobacco
  • Products sold to add flavor to tobacco

On January 1, 2025, the rules expanded to products that create a cooling sensation, flavored nicotine analogs, and delivery and online sellers, who now follow the same rules as stores.

The Unflavored Tobacco List

The California Attorney General keeps an Unflavored Tobacco List. If a covered product isn’t on the list, it’s treated as flavored and can’t be sold or stored for sale. That’s why a shop may not carry a tobacco-flavored product you’ve seen elsewhere.

What’s still allowed

ProductStatus
Unflavored products on the UTLAllowed, 21+
Flavored premium cigars ($12+ wholesale)Exempt
Flavored loose-leaf pipe tobaccoExempt
Flavored shishaOnly at licensed hookah tobacco retailers that admit 21+ only
Glass, pipes, grinders, lighters, storageAllowed (not tobacco products)

What California smoke shops can’t sell

  • Kratom and 7-OH products. The California Department of Public Health declared them illegal to sell in October 2025.
  • Cannabis and most hemp-cannabinoid products where tobacco is sold, under a law that took effect January 1, 2026.
  • Flavored vapes and menthol, as above.

Why shops take it seriously

Retailers face civil penalties starting at $1,000 per violation and can lose their tobacco license after repeated violations. Products can be seized during inspections. That’s why our shelves look different from shops in other states.

Online and delivery orders

Since January 1, 2025, delivery services and online sellers have to follow the same flavor rules as stores, and they must verify that the buyer is 21 or older. That’s why the person receiving a tobacco or vape delivery has to show ID at the door.

Local rules can be stricter

California lets cities and counties add their own rules on top of state law, such as tobacco retail licensing, limits on where shops can open, or bans on certain products. If you live or shop in another city, its rules may differ from Santa Ana’s.

How to tell whether a product is legal here

  • It’s unflavored or tobacco-flavored, with no cooling or “ice” effect.
  • It appears on the Attorney General’s Unflavored Tobacco List, which is public.
  • It’s sold by a licensed retailer that checks ID.

When in doubt, ask the crew. We check the list before anything goes on our shelves.
